We have had a very busy start to the year with our series of weekly Employment Strategy Sessions, Sponsorships of Sussex v Brighton University Moot and Patcham High School Tigers Lair Final.

The second inter university Mooting Competition between Brighton University and Sussex University. The contest offers final year law students the opportunity to practice their oral and written skills by applying them in a simulated courtroom setting in front of three Judges.

The Moot took place on at Sussex University, and saw a lecture room transformed into the House of Lords for the evening. Students who had performed best in their internal Mooting modules, went head to head to argue both sides of a fictitious criminal law suit. The Moot was chaired by His Honour Judge Niblett, Jeremy Gold QC and Head of Chambers at Crown Office Row James King-Smith with approximately one hundred invited guests who turned out to watch the competition. 
Howlett Clarke sponsored the Moot and provided prizes for the students which were presented by Richard Schaverien, Partner at the law firm. The students from Brighton University were the winners with Matilda Cram and Emma Barlow receiving an engraved Silver Salver and book tokens worth £75 each as first prize, and as the runners up, Sussex University, James Jacobs and Danish Butt who were both commended by the Judges for their presentation, received book tokens worth £25 each.   The event was followed by a reception for all the invited guests organised by the firm.
 
   His Honour Judge Niblett, said  

“It was a real privilege to be present at this Moot alongside my fellow judges. The presentations were excellent and of the highest calibre and all the students displayed very real talent - choosing a winner was a difficult choice and Brighton’s students just won by a narrow margin. Thanks also to Howlett Clarke as this competition wouldn’t have been possible without their sponsorship.”

  Matilda Cram and Emma Barlow, who led the winning Brighton team acting as Counsel for the Crown said

  'It was an honour to be given the opportunity to represent the University of Brighton in the annual Brighton v Sussex moot. Although initially it was quite nerve-wracking, once we commenced with the delivery of our case, the whole experience was very enjoyable and exhilarating. When the Judges announced their unanimous decision we felt a great sense of achievement, being rewarded for all our preparation and demonstrating the skills and abilities of Brighton law students. This experience provided us with the opportunity to gain an insight into the processes involved in the administration of the justice and has reinforced our ambitions to proceed with a career in law. We are very grateful for the prizes that Howlett Clarke provided and also for making the whole experience possible .”

Patcham Pupils enter the Tigers Lair!

  Pupils from Patcham High School in Brighton raised nearly £250 for various charities in the 2009 final of Tigers Lair. The competition successfully organised for the second year running by teacher Andy Hulks, saw teams of 3 pupils from throughout the school putting their presentation and business skills together for a chance to win the first prize of an iPod shuffle each.

During previous rounds the original teams from throughout the school were gradually eliminated down to 5 finalists and were presenting their pitch in true nerve wracking style to the three Tiger Judges and in front of an audience including The Head Teacher, other members of teaching staff and some proud parents.  

The 5 finalists were given a £10 loan by Mr Hulks and had to make as much money as they could by creating a business plan and scheme, working to ensure maximum profitability and viability as an authentic business model. Any monies made were donated to the charity of the team’s choice.

Using Powerpoint presentations, the teams presented their schemes to the Tigers, who were every bit as ruthless as the Dragons in Dragons Den. The schemes were scrutinised closely and the teams questioned about the proposals until one winner was chosen.

The Tigers judges, Mark Seltzer from Howlett Clarke Solicitors, Paul Bonett from Bonett’s Estate Agents and Peter Reeve from Reeve Lettings, were delighted to be invited back for this series of Tigers Lair and used their experience to mark the following categories; Ideas/originality, Business plan, Success of business, Presentation and Evaluation. All listened with great attention to each team, and the final scores showed how close a competition it was with only 3 points separating the top three teams.

The teams ideas for raising money varied from clearing and tidying up for teachers after class, having a “Chilax” room for pupils to come out of the cold and drink hot chocolate during lunch, making plastic photo frames on behalf of a charity, organising various sports competitions and having a sports newsletter to promote their events.     

The all girls team named “Shelleys Bees” were delighted to accept their prize iPods shuffles kindly donated by Peter Reeve. The Runners up each received £10 book tokens donated by Howlett Clarke and £5 book tokens went to all entrants as appreciation for the hard work that had been put in. The charities that benefited were The Martlets Hospice, Cancer Research, Demelza Hospice, Great Ormond Street, NSPCC, Alzheimers Research.

Comic Relief

Howlett Clarke staff raised £63 for Comic Relief by staging a dress down red nose day.

Over the last year the property market has changed beyond recognition and probably suffered worse in the recession than most other sectors.   There have been unprecedented levels of redundancy for all property professionals and some of the national conveyancing factories have either closed down or made massive staff cut backs.

 

Whilst at Howlett Clarke we have not been immune from the economic crisis we have taken a strategic and client focused approach to it.   One thing which has become clear over the last decade or two is that as a nation we have become obsessed by property whether it be our own to live in or an investment property as an alternative or add on to the traditional pension.  

With that in mind we have no doubt that when things start to improve the property market will recover quickly.   Indeed in the first month or so of 2009 we have seen dramatic signs of improvement.  

 

In our property department the emphasis has stayed on retaining high quality staff and ensuring that the service we can offer is the best that can be managed and superior to the majority of our competitors.   Many so called specialist HIP companies have gone under in the last six months as well as some law firms yet we remain and will continue to do so.   The emphasis has swung back from low quality bulk conveyancing companies, who obtain the vast majority of their work through paying estate agents referral fees, to traditional law firms who can offer both expertise and continuity.  

 

We have reviewed our Home Information Pack procedures and enhanced our service by now offering online access to HIPs for both clients and estate agents.   We believe we are still the only company to offer a full HIP including the optional documents and for which the HIP is checked by an experienced solicitor.   In addition we advise our clients of any issues which may come up on sale so these can be dealt with while the property is being marketed rather than becoming an issue say six weeks after a buyer has been found.

 

We have decided against making a separate charge for HIPs provided we are instructed to deal with the sale of the property once a buyer has been found.   We continue to do local searches through the Local Authority as the service offered by them is excellent and we obtain answers to all the questions.   Most HIP companies use personal searches because they are cheaper and it adds to their profit but these searches can be unreliable and do not provide responses to some of the most important questions.  

 

The way the majority of HIP companies work is to charge a global fee and then get the cheapest components available and do the bare minimum which means the HIP in our view is flawed and close to worthless.   A number of them will factor into the cost a referral fee to the estate agent who will try and persuade people to use that HIP provider for that reason.   Also the small print may state that ownership of the HIP remains with the estate agent so if the client wishes to change estate agent they either have to pay an over inflated fee to buy it or commission a brand new one.   At Howlett Clarke we do not pay referral fees to any of the component providers and we provide a full breakdown to the penny so clients can see exactly what they are paying for.    

Ownership of the HIP remains with the client.   

We believe in keeping things honest and straightforward.  

 

With a Howlett Clarke HIP once the buyer’s solicitor has this any additional enquiries are kept to a minimum thereby increasing the chances of the sale not only going through to completion but also with the minimum of fuss.
